They're not fictional, they exist. They're just parasitic on social convention, which isn't quite the same thing.

(The problem with social constructionism isn't that it's wrong, but that it's applied far beyond its proper ambit. There are plenty of things that are socially constructed, though lots of them aren't /just/ socially constructed. Governments are though.)
