This is a very bad take. Handshakes carry weight, sure ... but what is the AGREEMENT that they affix themselves to? The beauty of a written contract is that it forces both parties to contemplate the EXACT, SAME details ...and then gives an arbiter, later, access to the same. https://twitter.com/Kyle_Moonlight/status/1075119610389774336 …

2/ The "sola handshaka" stance blows up almost every single time in practice. "I'll sell you this XYZ for $2,000" "deal" <shake> "this XYZ is flawed in manner Q" "I know, right?" "I WANT MY MONEY BACK!" "But we shook!" "WE SHOOK ON A WORKING XYZ!" "xyz DOES work" "NOT RE Q!"

3/ Tests are good in code because they force you to confront exactly what you expect your code to do. Contracts are good in life because they force you to confront exactly what you think the agreement is.

4/ This is an excellent defense of a bad take. I've sometimes eaten crap on a bad deal to preserve a friendship... but one shouldn't have to. Nail down the terms. The contract is a FORCING FUNCTION to make sure you both agree on the full set of terms.https://twitter.com/Plinz/status/1075127711524405248 …

The handshake conveys an implicit commitment to a shared immune response, i.e. the statement of the intention to play a long game with each other.

5/ It's not JUST about honor. Two honorable people can each have different understandings of what a deal is ... and then, only after commitments are made and opportunity costs triggered, might the misunderstanding become clear. No malice needed.https://twitter.com/sdeslav/status/1075128227625164800 …

somehow i feel this relates back to the neighbor. :) it's true tho, it only works if both sides are honorable (handshake deals). these days? i try to get as much in writing as possible.

6/ "Honorable people can do a deal on a handshake" is a recipe for two ACTUALLY HONORABLE PEOPLE to each declare the other dishonorable for not abiding by the "clearly intended" terms of the deal. DO YOU WANT FEUDS? BECAUSE THIS IS HOW YOU GET FEUDS! #ScotsIrishINTENSIFIES

Contracts are code written in a terrible programming language. Contracts often need fixing, extensions, and exception handling. A shared agreement on the intention behind the contract can sometimes be more important than the contract itself.

8/ And yet, I've got hundreds of experiences where someone is relating a "he said/she said" story about some stupid crap, and I tune them out because I honestly don't care about the travails of people too stupid to draft a quick memo and sign it. https://twitter.com/mcclay_roman/status/1075132870421753856 …

9/ Compare: The blacksmith delivered the hinges, but they were too small for the intended door. I, the farmer, say "these are no good; I'll give you 18 bushels" "No, I delivered the hinges! Pay me!" "The WRONG hinges!" https://twitter.com/Oghma_EM/status/1075133473562742785 …

I always considered the handshake the good faith indication of *intent to do business* but never a final confirmation of an agreed contract. You go into a room, hash out a deal with the other guy, shake on said deal, then each go to your respective lawyers to WRITE DOWN details.
