Got a problem. Have a next door neighbor, who is the best guy EVER. ...but I think he's getting really bad information from the town planning board. I think the town is misreading their own zoning regs, and giving him permission to build an illegal structure.

If he has a permit, he can probably dodge the fine, but it’d impact property value or subsequent permit requests.

While generally adhering to the mind your own sea maws manner of thought...it never hurts to at least tell the guy that he should cover his butt with a review by an attorney. Sucks to throw money at it now but better that then some sort of theft later by the locals.

(iamnotalawyerbut) The tiny bit of reading I did when this first surfaced strongly suggested that if the town issues a permit to an illegal construction the construction remains illegal, and except in limited circumstances the homeowner is fully liable and the town is immune.
