Reading that thread (my first exposure to the issue!) it seems your position is not controversial, and may in fact be the law. Pilots obtain permission before landing, and land elsewhere if they don't obtain it. Emergencies are rare, and trespass claims after them are rarer.

... ah, wait, I read your tweet more carefully, and now of course must point out that your position ("ballooning should be illegal") is ridiculous. Pilots can and do consistently obtain permission before landing, thus ballooning is not inherently violative of the NAP.
