You are always justified in firing if you are justified in drawing. There is no situation in which you can threaten lethal force but not use lethal force.

I haven't watched the video. Someone said that he drew, and THEN the assailant backed away, and THEN he fired. If so, then that might not be justified. The attack would have justified drawing OR firing, but the retreat AFTER drawing would have made subsequent firing unjustified.

There was about 1 second between drawing and shooting. In between the guy who committed the initial assault backed up two steps, then took 1 step to the side. Were I the shooter, I would be very, very sorry that I had not been more reluctant to shoot. Even giving myself the benefit of the doubt, and knowing that my actions were legal and reasonable, I would be thinking "What could I have done differently to not take a life?"

Yep. Maybe. But law is not about the state of man's souls (at least, it shouldn't be). It should be about predictable reproducible systems that set incentives correctly.
