well actually Mark's original tweet was about the father trying to invoke the state's power. HE knows whether it was consensual or not (I assume). If it was, then Mark is right to criticize him. If not, then you're right to defend his desire to seek the state's power to punish.

The father is not seeking an investigation, he is seeking punishment. You are correct that society conducting an investigation is the correct thing to do when someone alleges an act that would be worthy of punishment. But society's actions are not the question at hand.
