It's a view point, think it's important because UDRPs will rise and so generic domain owners without TM rights, or developed sites, should expect the cost of their domain ownership to rise.

It's common for companies to try to buy a domain, then turn around and file a UDRP when they don't like the price for no real reason. And sadly, panels are not consistent enough in their findings on what constitutes IP violations.

Right. I accidentally let http://molsonhart.com expire. Someone bought it within 1 day and then resold it back to me for $260. I imagine that the is unclear on whether this was cybersquatting, for example.

Technically, no. Unless you had TM. Leaves a bad taste in your mouth of course, I get it. But on the flip side filing a legal action to take away "Books .com" because you have ProBooks .com (as a large co), is stealing. (as an example, not those domains, but similar has occurred)

Only stealing if it works. Otherwise you’re just asking.

You get into some ugly scenarios, even between companies. So ultimately the question becomes is it worth your time. Both sides can do a lot more to commoditize the domain industry, or make things more reasonable.
