I don't think I said it was "deadly assault with weapon." If I did I take it back. Based on the pictures you posted, I think there's a very good chance this would be seen as a lawful act of defense. ("Surely" is not a word I would use in many situations, including this one.)
You did not. OP did. In a court of where reasonable doubt is the standard for conviction, there is no chance they are convicted. Charges will not be brought.
