Is this (almost certainly) lie sufficient for an SEC action? He has a disclaimer in his profile literally says not to trust anything he said about stocks.

As crazy as it sounds, I don't think that would be sufficient to protect him. If people still thought they could trust him, regardless of the disclaimer, I could see the SEC at least attempting to make him liable.
