You could probably argue that given that he worked at the same place as George Floyd.
Also, you can charge him with both 1st and 2nd degree murder according to what I've read @EricRichards22

I mean, they'll probably have to. Although I doubt it will go to court for months, at which point some other focus for outrage will have taken precedence. I'm slightly depressed that we're never going to know what was actually happening, and it will remain a field of tinfoil
