I don't know how you would begin to analyze this rigorously. I've been tracking cases of IP abuse involving online marketplaces because that's of interest to me, most of the cases I see are trademark, but there's a few patent/copyright cases mixed in.

You seem to be very eager to attribute some position to me that I haven't taken. I believe, based on my own experience and research, that there's a lot of abuse of IP laws in general, across all kinds - patent, copyright, trademark. I've been collecting suits documenting that.

Now, you can argue that this is outweighed by the opposite kind of abuse - efficient infringement, as you called it. I don't know. I haven't looked at the numbers to any level of detail. Just documented the cases I see on one side.

No. Efficient infringement is THEFT! Full Stop. Big Corporations don’t have to actually invent. They steal. They have one act. Independent inventors & small entities are, by far, the most innovative. Historically. The “innovation” since patent reform? Where is it?
