Ultimately the courts are the final arbiters, but you would first appeal through internal IRS channels generally

(Not an expert but) I think most of the monetary penalties for underpayment don’t care about intent. If you owed and didn’t pay on time, there will be penalties beyond the original taxes owed even if it was an accident
