Courts would botch enforcement of insurance contracts more than they now botch administration of prisons?

Should courts also crack down on BDSM, to prevent cruel and unusual sex?

BDSM is consensual. Going to prison usually is not...

Under the proposal, the punishment would be consensually chosen by insurer and client.

I don't know about this proposal. I only read your conversation. For whatever it's worth, I've spoken to a lot of former inmates, wardens, and people from other countries where prison is much tougher. They all say prison is too easy and that is why recidivism is high.

For a lot of low-IQ felons, 3 meals a day and a structured life is better than trying to grasp the intricacies of modern Life (rent, applying for jobs, debt, etc.). I don't know enough about prison, but I think the way the Chinese do it (tons of manual factory labor) looks better

I'm pretty sure Tyler would oppose that even more. But I agree that looks more likely to be chosen consensual via insurance contracts than is our typical prison plan.

Maybe if we framed it differently he could be swayed: Having our massive prison population engage in more manual labor would lower recidivism rates, train labor, and be a component of restarting manufacturing in this country. The positive outweighs the negative. Growth.
