So, Qasim Muslih is being released by the Iraqi judiciary, after 13 days in detention. I'll be writing on this but here are some highlights to frame the issue. In Iraq, an investigative court has 15 days of pre-trial detention to make its case. This deadline was looming today.
Today, the investigative court asked for more time but were denied by the Higher Judicial Council, who ordered the release (and thus exoneration) of Muslih on the current murder warrant. This was high-level intervention, as expected, and even quicker than expected.
It took 14 weeks for the June 2020 KH rocketeer to be released after the pre-trial detention was extended multiple times. This time, no extension was given and "sufficiency of evidence" was determined very strictly. Militias were desperate to get Muslih out, and it showed.
In my view, the executive branch (from PM office to defenders of the IZ) did their jobs, but a chain is only as strong as its weakest link -- and in this case the weakest link was the Higher Judicial Council / judiciary in general. This is the next brick to rebuild to make a wall
Michael I knew people who got detained for more than 3 months just because they were waiting for blood tests results which ironically in Iraq take 3 months or sometimes more. It's like there is two separated countries, one for the people connected to militias and one for others.
Michael, I think it's time to stop the PR job for @MAKadhimi, he has failed miserably in everything he intended to do and Iraqis continue to be killed almost every day by militias under his rule.
