Roughly, legalism says that if something is illegal, it's wrong to do it, and anyone who does it should be punished, regardless of other circumstances; conversely, if something is legal, no one should experience negative consequences for doing it.

1) The judge should toss it. 2) he should demand a jury trial. 3) theft implies taking an item of value from someone else. The vaccine is of zero value after 6 hours. He didn't steal it, he preserved the value of the vaccine.
