Biden reiterates his preference to convince all 50 governors to issue mask mandates, but is also considering an exec order, saying "our legal team thinks I can do that based upon the degree to which there's a crisis in those states and how bad things are for the country."

Biden's legal team may think a federal executive order mandating facemasks could be constitutional, but good luck getting that past this SCOTUShttps://twitter.com/MikeSacksEsq/status/1237039651191435273 …

Hey remember when Justice Breyer asked a star member of the conservative legal bar whether the federal government could mandate vaccinations during an outbreak that could sicken half the country's population, and that lawyer said, "nope, sorry"? I do: https://www.supremecourt.gov/oral_arguments/argument_transcripts/2011/11-398-Tuesday.pdf …

What this tells me is that Biden's legal team is eager to play constitutional hardball with the Supreme Court's conservative majority, daring them to vote against public health with the hope it'll move public opinion on court reform.

But I think that overplays a President Biden's hand, and could just lead to a scenario where public health falls deeper victim to the pandemic's polarized politics

It's noteworthy that Biden just weeks ago suggested he didn't have the power to issue a federal mask mandate, saying "I'm a constitutionalist, you can't do things the constitution doesn't allow you to do." https://www.c-span.org/video/?c4906887/user-clip-biden-mask-mandate-9220 …

And Biden was answering a question based on a widespread, willful misrepresentation of his initial call for a mandate in August, in which he EXPLICITLY SAID "every governor should mandate - every governor should mandate - mandatory mask-wearing."https://www.youtube.com/watch?v=mmiIGbg_LAk …

To sum up: Biden in August called for a 50-state, governor-led mask mandate. Reports confused Biden’s federalism for federal action. Biden in early Sept says no, federalISM. Message still doesn’t stick. Biden today says fine, if you insist on saying I’ll do it, maybe I will

Yeah not at all astonished by the amount of umbrage towards a likely unconstitutional action that would further public health and harm no one from those who’ve sought to justify every actual unconstitutional action that serves no end but to inflict actual harm on real people.

Yes loss of personal liberty at the hands of governmental overreach is a harm, but the backwards sense of proportion on what actions really augur freedom’s end sure is something.

But that’s ok, keep cheering on the exploitation of our constitution’s every anti-democratic lever necessary to perpetuate minoritarian rule because a mask mandate likely to be struck down by the courts before it harms exactly no one is the real threat to American liberty

I guess, but he can't play constitutional hardball until he's in the Oval Office, and I'm not quite clear on how calling for this right now is going to endear him to those whose votes he needs to get there.
