This is an interesting take. A lawyer working on moderation/enforcement at a private company actually knows quite a bit about ToS, which is what is relevant to their policy decision. Not the Bill of Rights at all, despite the current popular framing of the issue in the discourse.
Following this thought through on a different direction, I wonder what the over/under is if the first move to outright ban GPT3 in a westernized country comes before the end of 2023.
