Whistleblowers need better protection! We should: 1.) narrow the language (of Espionage Act) to include ONLY credible intent to harm national security. 2.) ensure unclassified documents can’t be retroactively classified to punish dissent. 3.) include a ‘public interest defense.’
The Espionage Act is a broken, antiquated law in need of revision. Administrations have exploited its vague language to punish whistleblowers. It’s fine to retroactively classify documents as long as it is illegal to hold someone accountable for mishandling classified information if it wasn’t classified when they did it.
