With respect, no. Title IX is broken. Our criminal justice system even more so. They have different outcomes, standards of evidence, and obstacles. Using one does not preclude using the other. Survivors should choose what will serve them best--both, one, or neither.

Undocumented and/or PoC survivors may have good reason to fear the police; the legal investigation can be retraumatizing; one has to meet a nearly-impossible standard of evidence for events that are often he-said/she-said; harassment of men and genderqueer ppl gets dismissed

There are no good options. All have costs; all carry vulnerabilities to retaliation and personal/career security. But the potential to deal with this stuff under Title IX from 2011 on, thanks to groups like , has been a monumental step forward.
