  1. The answer more than 80% of respondents gave is probably correct, but I think a respectable (if somewhat complicated) case can be made that Michael Bloomberg was the winner.

Diversity statements as litmus tests. Told you so.

FOIA of documents at UC Davis with respect to diversity statements of applicants for faculty positions suggests that only certain beliefs are acceptable to screeners and that they are used as a litmus test (not “holistic”).This will subvert reducing bias.

  5. As the evening wears on, and interest wanes rather than heightens, it looks more and more like the winner tonight is ... Bloomberg (who chose not to play in the Iowa caucuses).

  6. For the November election, please choose: 1 If you are or lean conservative & think Trump will win. 2 If you are or lean conservative & think Trump will lose. 3 If you are or lean progressive & think Trump will win. 4 If you are or lean progressive & think Trump will lose.

2/ it will try to cheat him out of the nomination once again. This time, though, it will be more difficult. The Sanders campaign and its supporters have learned from experience. They know that it's happening and will fight back hard. They're not going to take this lying down.

1/ The Democratic Party establishment is terrified that Bernie Sanders will prevail. Yet Sanders' socialist economic views and extreme social liberalism are firmly shared by the Party's base. The establishment itself doesn't so much oppose them as it desires them to be hidden. So

Federalist Society people at many law schools can justly say to their friends on the "liberal" side, "we practice what you preach."

Credit where due: Harvard Law School has made, and makes, a real effort to diversify its faculty--kudos to Deans Kagan, Minow, and Manning and to the HLS faculty itself. Students of all perspectives richly benefit from the diversity. Prospective law student? Go to HLS if you can.

I really provoked the excitables with this one. It actually wasn't my intention, though it's interesting to watch. I'd love a discussion of the absence of serious viewpoint diversity on law faculties. I'd like people either to try to justify it or say what can be done to fix it.

Precisely. makes the correct point that there's a political as well as an academic side of the Fed Soc. It sponsors balanced debates, but also promotes conservative and libertarian legal ideas--ideas missing in most law schools. But it's no more political than the ABA.

At a typical Fed Soc event one might hear Michael McConnell, Nick Rosenkranz, Edith Jones and Randy Barnett; but one's also likely to hear scholars and jurists on the other side, such as Martha Minow, Merrick Garland, Jack Balkin and even Mark Tushnet. Compare, say, an ABA event.

The effort to demonize the Federalist Society as a sinister uberideological organization that judges should steer clear of is silly. There's far greater viewpoint diversity--and more robust debate--at a Fed Soc convention than there is on a typical (e.g. Yale) law school faculty.

Who'd have dreamed that it would happen during a Trump presidency, but the sheer pro-abortion extremism of the Democratic presidential aspirants is driving prolife Democrats onto the sidelines or over to the Republicans. Nearly 1/3 of registered Dems self-identify as prolife.

It seems that the first shots are being fired in the civil war on the sexual left about ... sex (errr ... gender ... or something). Will it be a quick victory for the currently ascendant side, or a drawn out and bloody affair?

State historic Christian teaching. Get angry pushback from the Woke. Quickly cave and beat a humiliating retreat, alienating the African and Asian churches in the process. Rinse. Repeat. "Church sorry for saying that sex is just for married heterosexuals":

AND they're going to lose the case at the Supreme Court--perhaps even by 7-2. Yet having been driven by the logic of Woke ideology into the cul-de-sac, they have no way out. Lesson: When your ideology compels you to sue the Little Sisters of the Poor, re-think your ideology.
