It is grammatically nonsensical. There are legal cases decided against parties because of a MISSING COMMA. It changes the meaning! I will die on this hill.

They’re a newspaper, not a lit journal. The New Yorker magazine uses the serial (Oxford comma). PS this is like the 2 space debate: it’s over. Oxford comma won.
