Not according to Simon R of Society of Conservative Lawyers, who says even if in customs union can set own rules. He is a legal procurement specialist btw

Not a specialist, or lawyer. But we took same approach on some big tax areas (ignored EU laws and used our own). We were hammered in the Courts, repaid poss £bn, changed laws and approach. So forgive me if I'm not convinced by opinion of one lawyer. Would want extended analysis.

The narrow point is right - no connection between customs union and procurement. The substantive point is wrong. Transition will preserve all Directives to 2021. 1/2

And the EU27 are clear that any trade deal must preserve State Aid and similar rules that ensure a level playing field. Procurement is likely one. 2/2

Only in the hardest of hard Brexit scenarios will the Directive fall away in 2019.

Just a reminder that there were promises to “stop tax avoiders getting Govt contracts” after the 2001 Mapeley deal. It was found not to be possible under the Procurement Directive. Background: http://news.bbc.co.uk/1/hi/business/2263208.stm …

Not so long ago public procurement preferring Fairtrade and Living Wage was viewed as illegal. Now commonplace. We are going to make the same happen on tax dodgers. Gonna engage local, national and EU levels. Happy to work with all who have common aims.

The EU Directive allows for social & enviromental stds linked to product/service being directly procured, but not general group wide policies (of course Directives can be changed, but its not a straight parallel w current treatment of fairtrade and living wage)pic.twitter.com/ldHORMEt8j

And as Sarah Mark argued so clearly those rules are there for good reason. Its not just jobsworthiness, naysaying, bat-poo crazy neocons and neoliberals or what have you... so needs to be taken seriously.pic.twitter.com/2QCPewyzGl
