Head of Legal at @EHRCScotland, Lynn Welsh, responds to today's announcement by @S_A_Somerville @scotgov of the consultation on the draft Gender Recognition Reform Bill.pic.twitter.com/46dV2Gldl8

Lynn Welsh from EHRC Scotland: This Bill offers a welcome opportunity to remove unnecessary practical barriers trans people facing in securing legal recognition of their gender identity.
Nothing in the Bill will threaten the continued operation of the Equality Act provisions protecting women-only services and spaces, which recognise the particular needs of women and the need for protection from sex-based violence.

Is Lynne Welsh being disingenuous, or could the head of legal be confused about the law, or is she hoping citizens are? If males can self-identify as women, no pre-existing protections for single-sex spaces & resources are capable of excluding males.

The Equality Act 2010 allows for female-only services which are not provided to men or transwomen who do not have a gender recognition certificate. Allowing a self sex identification process will mean that the sex exceptions below cannot be applied to keep female-only provision. pic.twitter.com/6XDbDJgRJo

Its weird because the EqA doesn't specifically recognise "need for protection from sex based violence" AFAIK (?) All the single sex exemptions are symmetrical (apart from in practice, sport) recognising that there are times & places where it is appropriate to have *privacy*....

also meeting specific needs, freedom of association. The Equality Act says "proportionate means to a legitimate aim". It does not specify "protection from sex based violence" as THE reason for providing services where men (including nice men!) are excluded

Well, at least the EHRC understands males pose a threat in female-only spaces. Yet they refuse to acknowledge that’s the reason why women fought for single-sex spaces to begin with...Strange inconsistency.
