For sustainable, legally enforceable protections we need 1. precise definitions & 2. to ensure that definitions are narrow enough so that those identified as within a precise class share common band of needs/experiences of the problem you are seeking to address by legislation
I'm reminded of a debate on poverty some decades ago. It was claimed there was no "rich" and "poor" because you can't show the boundary. Lord Bauer said equally no such definition of "day"/"night" but was fairly sure everyone agreed they existed. Same for "no such thing as sex"?
We do know where the boundary is though. We all do. Every human on earth is either male or female (yes, even "intersex" people). We can tell a person's sex when we interact with them even very superficially. Even if it's a man in a dress and makeup. Even if he's had surgery.
