What prompted MF to use belief as the protected issue? Was it the only legal route to sue? As an atheist, I agree that ppl have the right to hold and express religious beliefs but are things like facts about anatomical, sexed bodies as nebulous as a religious belief?

I wondered about that. There are two sexes, immutable in mammals; these are not 'beliefs' as I understand the word.
"Belief" in EqA does not preclude being based on fact. The case law (Grainger) is climate change. A man who believed it is both real AND critical we act on it. I believe that sex is real, binary & immutable (because it is!) & important to recognise (for fairness, feminism etc..)

Ah I see. Okay, I did wonder how it might relate to climate change/ vaccination etc. if the term ‘belief’ (based on this as a potential precedent) tarred everything with a religion brush. Thank you for that.
