Sorry if my original tweet was ambiguous. I believe the Pink News view of the law to be incorrect. We do not have gender self id in this country so in my view single sex spaces are properly limited to cis women and trans women with a GRC. Which also seems to be Center Parcs view.https://twitter.com/artefactoid/status/1189665758441332736 …

The equality act also protects people who are in the process of transitioning, not just those with the gender recognition certificatepic.twitter.com/ZD8Rk9ZjrO

There is a difference between the protected characteristics of sex and gender reassignment. The legal comparator for a transwoman without a GRC is a man, not a woman.

But in either case shouldn't women using communal changing, sauna, spa etc... be allowed to without encountering males . No physical changes are required for a GRC. I don't think it is an access-all areas pass, it is about protecting a trans person's privacy in everyday life

"Should " maybe but I don't think that's the law. I think trans women with GRC are allowed. But I know others disagree.

The EqA specifically allows for exemption from gender reassignment discrimination in the the case of single sex services. For example a cervical smear test clinic is for women (= females). GRC makes not difference. Similarly a place where women expect bodily privacy from males

I'm not sure that's right. I think a GRC means you are treated as female for pretty much all legal purposes (subject to some defined exceptions eg peerages). That's separate from the Q of discrimination law protection for trans people. Clearly though if something...

The EHRC guidance gives the example of rape victims' services as one from which a transwoman with GRC can be excluded.

Yes, interesting, was just looking at Schedule 3 para 28(2) and can now see how that might work. Thank you. http://www.legislation.gov.uk/ukpga/2010/15/schedule/3/paragraph/28 …

And of course Center Parcs is not saying people have to use the male or female facilities or be excluded altogether. They * also* offer private changing for anyone for whom communal changing would be inappropriate, or who prefers ... It seems like this is what the EqA might allow

My main problem with Center Parcs is that they can't spell.
