Nope. Thats not how discrimination by perception works. If a facility is for female people only it can specify that clearly. If the criteria for booking is "are you female" and the answer is "no" then someone is NOT being discriminated against "as a woman" by not being included.

Yes both being a man and being a woman is a protected characteristic. If a male is mistaken for a woman and harassed or discriminated against "as a woman", then that's discrimination by perception.

But in terms of comparators for discrimination purposes a transwoman without a GRC should not be discriminated against compared to any other man.
