...but we cannot assume that everyone has a 'gender identity'. What everyone does have is a sex. And there are specific human rights protections for women and girls as a sex. This should not be confused with belief/disbelief in gender identity, or with how people dress etc...

Belief systems have a historical tendency to translate poorly into government policy enforced by armed officials. Something about the Inquisition, and burning people at the stake.
