Now, I'm not saying this should be applicable to EVERY video, but it would definitely be a step in the right direction for certain other channels where the use of other people's content does not fall under Fair Use. What would your thoughts on that be?
The argument would most likely be that without the copyrighted content being included, there wouldn’t be content in the first place to make a claim of. So the copyrighted materiel is what drove the creation of the transformative material. An attack on fair use probably.
If it was a correct claim yes, but this is obviously fair use and most content getting claimed on Youtube are transformative. So I'd rather have people who make false claims like her get punished.
Obviously this is a false claim and she should be punished, I'm not denying that fact - I'm just curious to see what other people might have to say about the proposal of only giving the claimants a set share if their claim is actually valid
