Its really not that easy. Anyone can fork the kernel as is, but it still has to be maintained and updated to fix bugs and improve performance. The code itself isn't being held hostage, but you have to have or find the right talent and dedication to keep it up.
And coding kernels is difficult and mind-numbing, hence why there aren't new kernels being created all the time and were still using one from 30 years ago.
Indeed, fork from a CoCless previous kernel version & uplift it. Unless they allowed their "meritocracy" to become a sufficiently large sampling set for gender dysphoria.
