Duh. It's intended for true emergencies, not Trumped up ones.
I don't think the statute was intended to replace Congress in the appropriations of funds. That has never happened before and I'm betting that he will lose it in the SCOTUS.

Same way you can be accused of being a US Senator. Technically, this is true, but it’s definitely not for the good of the country.
Did that statute include giving him the power of the purse? Did it include declaring an emergency after congress voted on the issue and appropriated funds it deemed necessary? Only to have Trump say “I didn’t need to do this”?
