Today a judge declared a mistrial in an arson trial we were prosecuting after one of the jurors tested positive for COVID. The virus continues to challenge our legal system and our courts. The Delta variant is real. We must all remain vigilant to keep everyone in SF safe.

What about last year then? Rules were in place to conduct remote court. https://www.courts.ca.gov/documents/appendix-i.pdf …

This is from the governor's office. Individual county courts had discretion.

OK. But as Mano Raju has been complaining, they still haven't fully opened. Right? Who makes those decisions? The head of the court, right?

The Recorder stated that SF "courts were exempt from executive orders". Emergency Rule 3 provided the guidelines to adopt for criminal proceedings. Overbooked, yes. Closed, not entirely true. Nothing stopped the office from filing charges.

What charges weren't filed? Have a record or know how all cases were resolved? Just because they didn't go to trial, doesn't mean they weren't resolved. Have you ever heard of mitigation (AKA plea deal)? Have you heard of collaborative courts? What's your experience w/the law?
