Exactly. The Republican justification for both Garland and ACB is "the Constitution allows us to do it." This argument is PRECISELY as applicable to court expansion/reorganization and jurisdiction-stripping.https://twitter.com/jbouie/status/1315048165062643713 …

The thing is that the GOP had a good thing going with Roberts as the median vote -- overwhelmingly conservative results but very unlikely to trigger a hardball response. They decided to get greedy, and if that ends up with the Court blown up they have only themselves to blame

And Biden's answer -- Republicans have been packing the courts for 4 years, we'll see what happens after the election -- is perfectly reasonable. (Particularly since not only is nobody asking Trump about McConnell's 15-16 blockade, he openly boasted about it at the last debate!)

They hadn't pull that crap with Garland I'd be alot less pissed. Yes the 100+ lower court seats withheld is upsetting but that will more easily right itself. Add 4 seats (with @staceyabrams & @Sifill_LDF ) to SCOTUS and then talk about a Constitutional Amendment for real reform.

I only hope that 1. There is an opportunity to undue the damage of the GOP and 2. Biden and Dem leadership has the stomach to weather the criticism to reorganize the judiciary

Don’t quite understand this. If they didn’t squash Garland, median would have shifted from Kennedy -> Kagan. Garland kept the median at Kennedy and Kavanaugh shifted it from Kennedy -> Roberts.

This is about the rushing to fill the most recent seat. Median will go to the right of Roberts but invite backlash. Even with a Biden nominee Roberts would still be the median but with less chance of Dems retaliating

Do you think Biden will respond to a lame duck appointment more or less immediately with court expansion or wait til the 6-3 majority hands down some insane ruling as an excuse -assuming he backs it at all (the former would be the smart safe play)?

Doing it in response to a result would probably seem less legitimate. The other side is going to be pissed either way so might as well do it before a bad result if you can pull it off.
