Upon a showing of “good cause,” the court can order that any discoverable information – including a name – be disclosed to only the defense lawyer, and not to the defendant personally.
This is a standard practice nationwide, including in other “open file” discovery states like Texas and North Carolina. The procedure is proven to work. That’s why DAs from across the country, including Texas, weighed in to support New York's enactment of open file discovery.
