State At Home Order: > half of US sheltering in place @POTUS has no power to order stay at home & can't direct governors. He can give clear guidance, funding for implementation & give political cover to Red State governors. He Should! #PhysicalDistancing is key ph strategy 2x
Stay-At-Home Orders: States & cities probably have power to issue shelter in place order, as well as ban large gatherings. Orders should be proportionate, least restrictive alt. We should avoid draconian penalties or intrusive surveillance 3x
Business Closures: States have exercised "police powers" since Colonial era to abate nuisances, incl business closures. Entirely lawful. @Potus has no power to order businesses open or closed solely operating within state. Business closures & bans on large gatherings effective 4x
Governors cannot be travel to and from their state. This violates "dormant commerce clause" b/c Congress has exclusive power to regulate interstate commerce. #Quarantine of residents traveling from another state (Fl, RI) is murky w/o indiv assess of sign risk. 6x
Federalism is America's greatest strength & weakness. It allows states/cities to be laboratories of innovation. States/cities better understand local health needs.
