This is mainly for people worried about referencing! There was a period where I went from tracing everything to being worried that even glancing at a ref would be stealing, that it was a show of skill to do it from memory

I cannot emphasise enough how much refs help!! PLEASE USE REFERENCES!! If you gotta trace something to figure out how it works that’s fine, just keep it to yourself. You’re allowed to make stuff that’s only for you. Treat yourself

Parody/appropriation would take another whole damn guide to cover. It’s very legally grey. And intentionally so cause there are so many variables. Even doing something in fair use could face copyright action if the owner felt like it. It’s just…very weird to describe

@leonardjfrench has done some great videos on fair use. But some tips: All 4 factors have to be considered. A parody has to actually be saying something or mock the original. Fair Use is a legal defence to copyright infringement, only in court can something be declared FU.

Yup, parody is hard. To respond to the original and also talk about parody: It's perfectly okay to make a "not substantially similar" work that is inspired by the original. 1/

The frustrating part is you can qualify under fair use, meet 4 principles, and still deal with content owners disputing you, shooting down your defence to stifle you, and see them face no repercussions.

Well, there is laws that a copyright holder must consider if the derivative is fair use before filing a claim, and could face repercussions if shown they did not. But like any legal dispute, it can only be determined im court, which can be expensive.
