ICYMI, here’s my conversation with about the absurdity of Dershowitz’s claim that it’s not impeachable for a president to abuse his power and violate the public trust. via

Donald Trump’s disrespect for the flag would be shocking behavior for any other public figure. A city councilman would be driven from office. A country music star would lose her following. A preacher would lose his congregation. But what of this president?

Trump declared that Art. 2 of the Constitution let’s him do anything he wants to do. With an acquittal vote tomorrow, the Senate will put the president above the law. And when a president is above the law, so too is that president above and not accountable to the American people.

This is utterly disgraceful. And for Rand to blame his own misconduct on the Chief Justice is disgraceful as well.

Many GOP Senators announcing their reasons for acquittal are relying on alleged process failures or on doubts that Trump did what the House alleges. Sad but not nearly as dangerous as relying on the crazy theory that the offenses charged are just not impeachable. That’s wrong.

Sen. Grassly said “the Senate is governed by precedent.” Oh, really? Like the precedent that every other impeachment trial had witnesses testify? THAT is precedent. The air in the Senate chamber is so thick with hypocrisy, it’s a wonder anyone can breathe in there.

I agree strongly with and have been making this point ever since unfurled his ludicrous but enormously dangerous precedent-setting argument that the abuses of power charged by the House are not impeachable.

So it begins. What else did you expect? And an acquitted Trump will be an even more vindictive Trump. Here it comes!

The GOP likes to says there’s lots of voter fraud. Trump created a commission to address it in 2017 but it folded 8 months later because it couldn’t find any. The real issue has always been voter suppression by the GOP. It will be worse in 2020.

Every news organization should stand by its peer CNN, stand up against Trump and stand for a free press and the first amendment by boycotting the impeached president’s lunch.

I don’t think Jesus would take sides - apologies to Rep. Garcia - if he were with us. It’s annoying when someone does that, esp when reportedly Jesus said, render unto Caesar the things that are Caesar and to God the things that are God‘s. This is about crimes; nothing sacred.

Unless the 4 wavering GOPs join all 47 Dems in voting for censure, with McConnell giving them license to do so, Manchin’s censure move could serve only to give him and Jones cover to acquit, yielding a 55-45 acquittal margin and no majority to censure, the worst possible outcome.

Congratulations, Republicans. By refusing to hold Trump accountable for his crimes you’re enabling a lawless, out-of-control, petty, vindictive man who intends to use DOJ to conduct politically motivated prosecutions of his enemies. You’re doing nothing but feeding the monster.

As good as the Dems have been, I would have 1. moved to exclude biased members of the senate & counsel, 2. moved for witnesses invoking the rules that make that the judge’s prerogative, not the Senators, 3. Object when counsel lied about facts/law. 4. demand a mistrial.

. is right: The Senate’s 51-49 “see no evil” vote is all about the GOP Cult of Trump, not about permanent presidential supremacy. No Democratic president could get away with lawlessness like Trump’s. Nor would one want to. Total asymmetry.

As just persuasively argued, Trump’s actions could be PROVED in court as extortion. I would add they also=soliciting a bribe: a govt official conditioning an official act (delivering aid to Ukraine) on a personal favor (sham Biden investigation).
