I think that's too hard to be a yes or no. Because let's assume the initiator has asked permission and been generally nice, they can't really know any better per se. But from the other person's perspective they can't really Express how they really feel
But let’s assume that this carries over to IRL and the person is continuing to act uncomfortable in hopes the person will notice and leave them alone. Who is at fault?

The person needs to speak up. It sucks and it might be really hard for them, but not everyone is adept at picking up social queues. If you verbally tell then something and it persists its easily taken care of by your peers or a TO etc etc.

Probably the initiator. People say "oh I didnt notice", but it's usually "I didn't want to notice." Although they could be genuinely oblivious. Hard to call. You could always try having a third party bring it up to them and then seeing if they initiate the conversation with you
