For over 230 yrs, all 3 branches of Government have respected the fundamental rule that the apportionment of House seats must be based on the total number of persons residing in each State. This should not be a challenging case for any Justice who respects the constitution.

For the strict constructionist/ Originalists on the bench — I would argue the Framers registered clear intent in Art. 1 sec. 2–for census purposes a Black man shall be counted as 3/5ths a man. The Framers wanted to leverage the presence of those not protected by the constitution
