The ocean scene where the two are swimming in a race and Vincent wins because his opponent gives up in the face of adversity and fails, this requiring Vincent to save the man’s life comes to mind. Vincent was unfairly assumed to be unfit at birth because he was born an outsider.

Even the movie's tag line is suspect "There is no gene for the human spirit" perhaps we just haven't found them yet... First law of behavioral genetics and all.

What would a "gene for" human spirit do? Genes are context-independent?

If the "human spirit" however defined can be reliably quantified. Then it's very likely the "human spirit" is heritable due to the first law of behavioral genetics. That's what I was getting at.

Honestly, I just assumed during the movie that the whole thing was a result of lawyers. A lawyer became principal of my high school, back in the day and it was amazing how many restrictions went into effect to "curb liability"
