It's a self-report, accepted by investigators, potentially verifiable by computer forensics, and consistent with what we know is her fulltime job (logging events) due to catastrophically bad design by Uber which guarantees failure even if she was on a phone in the first place.
Uber has no reason it wants to push the question. No one cares if one can prove phone use when Uber obviously made bad decisions. Any PR lawyer will tell you: bury the case.

Uber has every reason to try to throw the driver under the metaphorical bus if they could possibly get away with it. Remember how 'the pedestrian was on drugs' was all over the media? Or how Uber hired PIs to investigate that Indian rape victim to try to discredit her?
