My personal view is that this is not the easy goal it might appear to be. The incentives set up by adversarial legal systems hugely increase the rate of change in the legal system. An ‘active court’ can sometimes be just another risk-averse institution that moves v slowly

Yeah! Which also means that US judges are only supposed to rely on information or arguments that the ligitants provide themselves. If they think of a good argument that no one in court made, they cant use it in their opinion. They cant go google searching for information either.
