Whoever does these benefit assessments needs to be replaced and if the assessment is negligent they should be held personally responsible.

If undertaken by a registered nurse, therapist or medic they are personally responsible for their actions to their regulatory body. I have heard some assessments are undertaken by non-registrants though

It tends to be a very slow process - but it is vital that the regulatory bodies are aware of allegations of professional wrongdoing (usually triggered by an employer report - which is unlikely - but can cone from the public) and they can then undertake an objective investigation
