We’re providing funded fellowships for law students interested in learning more about First Amendment work who are at the intersection of multiple marginalized identities (with a special interest in funding queer and trans folks of color and disabled folks of color).

This program idea was kickstarted by a combination of three things: first, the fantastic work of fellows like
@JennyKorn and@kathytpham who have built spaces to talk about ethics, technology, race, and diversity, and whose expertise I continually benefit from.Prikaži ovu nit -
Second inspiration was the (many) conversations with
@dispositive,@jacklerner,@levendowski about the lack of race and gender diversity in technology law clinic teaching, and what we were doing about it.Prikaži ovu nit -
But most directly, IfRFA was inspired by the class in new issues in the First Amendment that I co-taught with the fantastic Martha Minow. It was her idea to have students present on First Amendment issue of interest to them.

Because Prof. Minow was teaching, we got a wide range of students, in terms of interests, identity, and background. We had future public defenders and consumer rights advocates in addition to students focused on religious freedom and technology law.

And the presentations were so fascinating! Students talked about the right to read in prison, the First Amendment implications of abortion counseling laws, voting as a First Amendment right.

The students saw the First Amendment as relevant to their work, even if they weren’t necessarily representing local journalists or protesters. And I see the First Amendment as relevant to mine, whether I’m working with sex workers, hackers, or journalists.

So IfRFA builds on those experiences, combined with direct financial and social capital support for folks who might not necessarily see themselves in traditional First Amendment practice (which tends to be male, pale, and stale).

We welcome applications from anyone who doesn’t see themselves as quite fitting within the mold of First Amendment law, whether because of race, gender, disability, sexual orientation, or something else we haven’t highlighted.

We’ve trying to avoid the most common traps of diversity programming - we’re requiring clinics that want to take fellows undergo rudimentary inclusion training before the fellows get there. And we’re paying for that training.

We’re providing opportunities for fellows to connect with each other, both within their cohort, and as we build a deeper back bench, across years.

And mostly important, we’re not measuring the success of the program based on whether the fellows become First Amendment lawyers. Exposing students to First Amendment practice and making connections is the end goal.

Will it work? No idea. We’re building this plane as we fly it, and we’re going to make mistakes. Will we get applicants? Can we provide meaningful experiences to the fellows? Will I mortify white dudes by pointing out how homogenous the First Amendment bar is? Stay tuned.
