TRUMP/COHEN: Rudy Giuliani tells me the president waived attorney client privilege related to Cohen '16 recording of Trump talking about possible payment to Karen McDougal “It was already out there so seemed no point in objecting except on principle.”

Think on it. No reason? Except to keep it out of court. Hard not to believe this statement doesbt conclusively show Trump side leaked it.

If they waived it why could it be used in court ?

They waived (gave up) any privilege to keep it private. Now it can be used to prove a conspiracy to violate the US campaign finance law (by paying to keep a bad story from public weeks before election)

Now that Vlad has the Helsinki blow job tap, did Rudy also waive Employer/Employee privlage and let Vlad release the peepee tape since it already out there?

I dunno. Seems to me he’s covering up a screwup (his own). If the SM granted privileged status, why let it be used by the prosecutors?

And if he really thinks it’s exculpatory, why not make that the sole reason for waiving privilege?

I’m fairly sure that what Giuliani said on behalf of Our Supreme Surrender Monkey is either a lie or a deceptive half-truth. That’s just a good rule of thumb.

Giuliani is lying. He is the one who leaked the tape. Either he blew it by talking about the tape. Or he meant to get out in front of the story. He wanted to capture the MEDIA narrative & DISTRACT from: Trump’s #TREASONSummit, #RedSparrow Butina, 12 Russians Indicted, LIES LIESpic.twitter.com/UwawZNVnVI

Please don't let them distract you from the Helsinki debacle and the soon-to-be Putin in D.C. debacle! The fact that this President actually was "considering" turning over Americans to Russia for interrogation?! This McDougal stuff was put out by the WH as a smoke screen.

That’s pretty dumb. If a privileged document is leaked or accidentally produced, you write a letter demanding it back & demand that whomever has it destroys all copies, etc. in there possession. You DON’T throw up your hands & say “oh well.”

I said “document” as default. It’s really “document or thing”. Privilege covering a recording works the same way. Even if the document/recording, etc. is “out there” you still get it back, reassert privilege and then it can’t be used by other side.

If you choose to let the recording remain “out there” then you’re waiving privilege (which they say they are doing). Then you have to worry about subject matter waiver opening up other documents or things.

#Giuliani is apparently a crappy attorney now, but the other attorneys on the matter are surely not thinking this. And if this recording is cut off, believe me, you’ll have the government figuring out where the rest of it and they will be entitled to it.

My guess is that they think they can use the tape(s) to help their case(s). I wonder if the partial tape helps more than the full tape &/or other related documents or testimony would. Hullo #PresidentNixon. Can the attorneys be this clueless re the contours of privilege & waiver?

There’s no way #LannyDavis, #EmmetFlood, or the #DoJ would operate like this. They have to know the law. Someone is lying; sloppy, ignorant, & arrogant; or #GoingRogue. (Rudy, I’m looking at you.)
