They waived (gave up) any privilege to keep it private. Now it can be used to prove a conspiracy to violate the US campaign finance law (by paying to keep a bad story from public weeks before election)

That’s pretty dumb. If a privileged document is leaked or accidentally produced, you write a letter demanding it back & demand that whomever has it destroys all copies, etc. in there possession. You DON’T throw up your hands & say “oh well.”

I said “document” as default. It’s really “document or thing”. Privilege covering a recording works the same way. Even if the document/recording, etc. is “out there” you still get it back, reassert privilege and then it can’t be used by other side.

If you choose to let the recording remain “out there” then you’re waiving privilege (which they say they are doing). Then you have to worry about subject matter waiver opening up other documents or things.

#Giuliani is apparently a crappy attorney now, but the other attorneys on the matter are surely not thinking this. And if this recording is cut off, believe me, you’ll have the government figuring out where the rest of it and they will be entitled to it. -
My guess is that they think they can use the tape(s) to help their case(s). I wonder if the partial tape helps more than the full tape &/or other related documents or testimony would. Hullo
