    Flake (or someone) should ask Kavanaugh: Now that the man who nominated you is an unindicted co-conspirator have you thought about withdrawing from the nomination? Do you feel as though Trump's predicament stains your nomination?

    And a good follow-up by Flake and Kavanaugh won't respond. It's an essential question, and he should be required to respond to it, because it goes both to why Trump picked him and how he'll handle inevitable clash between Trump and Mueller.

    Good question, Jeff Flake! About Trump's latest Sessions Tweet. Whether president's should impose such political pressures. And Kavanaugh chooses not to respond to it, which is both predictable and terribly lame.

    This won't get the attention it deserves. But it's a significant part of the story today-- challenging Kav on fact that he's now nominated by an unindicted co-conspirator.

    Blumenthal is up, noting Trump's position as an unindicted co-conspirator to federal crimes, asking whether Kavanaugh would recuse himself from any case involving Trump's liability. Kavanaugh says part of his view of judicial independence means he will not take such a position.
