Problem is the fact being concealed must not be within the reasonably diligent observation of the plaintiff. The bias was fairly obvious.

Can't anyone find at any time when the DNC told the public primaries are neutral? Has to be a written or oral statement somewhere.

They covered that part. What was missing was a plaintiff _relying_ on those statements.

IANAL but looks like a rookie mistake to me. Needed to allege that plaintiffs relied on DNC statements for it to be legally fraud.
