The Flynn case is fast becoming a case of gross judicial overreach as the court appears to assume both judicial and executive powers. Sullivan can disagree with the exercise of prosecutorial discretion, but he cannot substitute his own judgment for it.https://www.usatoday.com/story/opinion/2020/05/18/michael-flynn-jonathan-turley-judge-sullivan-fbi-column/5212869002/ …

...There are serious questions about the propriety of third parties being asked to argue against a criminal defendant. The lives and liberty of individuals generally are protected from public demands for punishment. We do not do punishment by plebiscite in this country...

...While H. L. Mencken once described a judge as “a law student who marks his own examination papers,” our system allows for appellate review. The fact is that such a judicially mandated crime and case would be likely dead before it could be properly captioned for docketing.

(FYI The headline of the columns is up to the editors, not the writers) Judge Sullivan will make this decision and I expect him to grant the motion. The troubling question is the purpose of inviting third party argument and the implications of substituting a new crime of perjury.

The Flynn team just filed to force Judge Sullivan off the case for bias. This is an extremely difficult motion to prevail upon in the federal courts. The interesting question will be whether the court makes reference to these controversial orders . . .

...The filing notably makes reference to the earlier sentencing hearing and Sullivan's controversial remarks. https://jonathanturley.org/2018/12/20/140351/ … The latest orders raise troubling questions of judicial overreach, but present legal questions that the court is unlikely to reach on appeal.

If you read the motion, the argument that Sullivan has no authority to appoint an amici in criminal court is the strongest argument made.

Jonathan what does it take for the Supreme Court to get involved in cases like this where the judge appears to be politically motivated and abusing power?

Sidney Powell is proving that she is the lawyer you want to hire to defend you. Top notch. Wish Flynn could go after Comey, McCabe, Rice, Strzok, Page with a big civil suit that would knock their socks off along with their bank accounts.

maybe the justice department should be dropped for bias, dropping a case when the defendant has already plead guilty (twice).

It is totally disturbing to watch these charades. Losing faith in humanity and the free world. It is outrageous. Continual biases, prejudice against Trump. Started well before he was elected. There should laws to forbid this kind of corruption. It is political mafia.
