With respect, Article 349 applies to all of the EU as it is in the treaties. There is no passive aggression or whatiffery to deflect with. EUCO can adopt whatever it likes through unanimity. What it *politically* "cannot" do is irrelevant. It will deal with NIP withdrawal with 349. Best to do it proactively, it'll be doing it anyway. May as well show some initiative.
