3. The EU and the NIP are both institutions sui generis, both created by the European Council without prior art. Article 349 IS prior art. The Commission may propose it as a solution for all of the RoI at a EU summit. Likewise, Ireland may request it of the European Council.
4. Article 349 under @bowgroup's proposal would apply to the RoI, not NI. So it is entirely within the EU's gift to adopt an existing Lisbon Treaty article, in the spirit of Europarl recommendations, to deal with a de novo challenge to the EU Single Market.
